We can say anything. Words are our tools of understanding; Our way of translating the world around us into a more comprehensible knowledge. We use it to describe what we believe as fact.
What we
cannot do, however, is change fact.
Your scenario for example: We could call the Marine the bad-guy or the Robber the bad-guy. Whichever we choose wouldn't determine the fact -- the fact always existed -- instead, we'd simply be attempting to gain a better understanding of the situation.
They may both be guilty of wrong-doings. However. It would be unlikely that both of them were equally justified in their actions.
*Justification, as I'm sure you know, can ride on a lot of things such as Natural Reaction, Motivation, Intention, etc.
... Or... They may both be "innocent"... In the sense that neither had control of the situation to begin with. Hypothetically speaking, of course.
If you can't blame the Marine for shooting the stranger that broke into his house and stole his possessions, and you can't blame the Robber for being desperate for something to live off of (assuming he is not acting out of malice and/or greed)... Then blame may belong to a different source.
Not all criminals are insane... Just as Not all criminals believe they are doing what's right when they commit a crime.
