I believe that is only if it is still under warranty?
I recently had one break - snowy artifacts started appearing - and we were told that we`d need to pay for shipment as it was out of warranty. And that all the saves contained within (a painfully large number that won`t allow copying to an SD) will most likely be erased.

We have two so I just switched out the office one with the living room and it`s still working, so we figure we`d might as well wait for it to totally die if it`s not going to be free anyway.

Actually mine was out of warrenty (and bought in Japan) but they didn't charge us. (This is for a DS.)

Mine was bought in Japan, but they fixed it in the US for free. I called them up, and they sent me a box to send it back to them in. The replaced the DS and mailed it back to me for no charge. I don't know why I was so lucky, maybe there was a manufacturing problem...who knows?

Have you not called Nintendo yet?
